General Standard Terms and Conditions
§ 1 General

All orders placed by you via the website and our deliveries and services are exclusively subject to the following general terms and conditions, in the version that is valid at the time of the order. We do not accept conflicting terms and conditions of the customer unless we have agreed to their validity in writing.
§ 2 Right to return
You may return merchandise that you have received without indicating any reasons within two weeks by sending the merchandise back. The time limit starts running one day after the day on which you have received the merchandise and instructions about the right to return enclosed separately in writing. Only in cases of merchandise that can not be shipped (e.g. in cases of bulky merchandise) you may exercise your right to return through a written request (e.g. by letter, telefax or e-mail). Returns will be accepted for consideration only when we receive them in the given time limit which means that you must ship it out on time. Return shipments will be at our cost and risk. Consequences of Return
In case of a valid return, the mutually received benefits are to be returned and eventually drawn profits (e.g. profits drawn from the use of the merchandise) are to be returned. In case that the merchandise has deteriorated, a compensation regarding the value may be claimed. This does not apply in case where the deterioration of the merchandise exclusively results from its inspection as it would have been possible for you in a shop. You also can avoid the obligation to compensate the value by not using the merchandise as if you owned it and by refraining from acts that might affect its value.
You will find all documents helpful in connection with the return of the merchandise - together with the delivery note - in your shipment.
Returns can only be shipped from the country to which the goods were delivered; e.g. returns on goods delivered to Austria can only be initiated in Austria.
All costs will be charged to your card or bank account. In case of a return, the card or bank will be credited. Please note however that any loses incurred due to changes in the exchange rate will not be credited.

§ 3 Important notes
1. The merchandise offered under mytheresa.com is presented on the Website in the format of digital photographs of existing merchandise. Minor divergences of the photographs from reality do not constitute a defect of the ordered merchandise.
2. Please note that merchandise presented on the mytheresa.com Website may no longer be available at the time of the customer΄s visit to the Website and that the respective prices may have changed. All prices shown are listed in EURO and exclude shipping costs.
3. Mytheresa.com is entitled to perform partial deliveries.
4. Gift certificates are valid for three years onward from date of purchase and cannot be returned.
§ 4 Conclusion of contract
1. The contract between you and mytheresa.com is not entered into until we send the ordered merchandise to you. By sending the order form provided on our website to us you make a binding offer to enter into the contract. You finalize the order by entering all information during the order process and sending the order form to us by clicking on the "submit order" button.
2. Mytheresa.com is entitled to reject orders without indicating any reasons, in particular if there is well-founded suspicion that the merchandise purchased via the internet is to be sold to third parties commercially.
§ 5 Saving of Contract
We save your order data. If you wish to receive a print-out of your order, you can print out an "order confirmation". This order confirmation will appear on your screen once you have completed the process by clicking on "submit order" and once your credit card data have been successfully checked. Furthermore, you receive the order confirmation with all given data by email which may be printed out as well.
§ 6 Delivery and Shipping
1. We ship exclusively with DHL. Mytheresa.com bears the transportation risk. We ship internationally to over 50 countries.
2. Merchandise is generally ready for shipping at the latest one business day after you΄ve placed your order. Unless otherwise agreed, the delivery will be made within 1 to 4 business days calculated from the time it leaves our warehouse to the address indicated by the customer depending on the shipping method and destination.
Please note that for DHL-Express-Delivery within Germany there is no delivery scheduled for Saturdays.
3. Customers in non-EU countries
The delivery period to countries that impose customs duty is 2 to 4 business days. Please note that we bear the insurance of the merchandise and any costs for supplementary documents. Product prices are exclusive of all taxes and duties, as well as German VAT. Please note that custom taxes, duties and handling fees for each individual country will be applied and invoiced separately through DHL. For details regarding arising taxes and duties for your country, please contact us at customercare@mytheresa.com.
Please note that potential foreign bank charges have to be borne by you.
International customs duties and sales taxes are NOT refunded for shipments outside the European Community (EU).

€ 15.00, only possible within the city limits of Munich and in case of payment with credit card or directebanking.com, delivery on the same day in case of order until 4:30 p.m. (Monday - Friday).
In case of partial delivery, shipping costs will only be charged once.
5. As a gesture of good faith, mytheresa.com is happy to award customers a store credit on items which were reduced within seven days of having been purchased at the regular price. The value of this store credit will total the difference between the sale and regular price and must be cashed in within one year of issue.
This action is only valid if the exact color and size of the purchased item is in stock at the time of claim.
This offer does not extend to items which were already on sale at the time of purchase or was bought during another action.
§ 7 Payment, Default
You may pay your order at mytheresa.com via credit card (Visa, Mastercard, American Express), direct-ebanking from your online banking account, wire transfer as pre-payment, or by redeeming a gift card / store credit.
All payments including refunds will be processed in Euros.
Procedure for payment with credit card
We accept the following credit cards:

1. You enter your credit card data on our secured payment website.
Mytheresa.com uses a state of the art security server software with a SSL interface (Secure Socket Layer). This is an asymmetric encryption method in the internet that secures your credit card data during the transmission process against access and manipulation. It is therefore impossible for third parties to read this data during transmission over the internet. We provide you with a comprehensive security and payment guarantee. You may receive more information under www.saferpay.com.
2. Upon the transaction we process your order within the delivery period indicated in § 6.
3. The outstanding balance will not be charged until the day your order is shipped.
Note: Credits resulting from returns will be transferred back to your credit card.
Procedure for payment with instant transfer via directebanking.com
1. Choose "directebanking.com" as method of payment from the options on our page. Please note that this service is only available to people who have an online bank account in Germany, Austria, Belgium, Switzerland, the Netherlands or Great Britain which allows for banking with PIN-/TAN codes.
2. Once you have clicked on this method, a window will open with a formula filled out by our partner Payment Network AG in which all the steps are carefully listed. More information is available under www.directebanking.com.
3. After the payment has been successfully transferred to our account, you will receive an order confirmation per e-mail and your order will be shipped in the delivery terms listed in § 6. The advantage of paying directly is that we can ship out merchandise immediately instead of waiting for the money to appear on our account.

Procedure for payment via wire transfer / pre-payment
1. You will receive our bank details and the order number in the e-mail that confirms your order.
Please note that we can only accept wire transfer payments for orders from Germany, Austria, Switzerland and Holland.

§ 8 Retention of Title
Until payment is made in full mytheresa.com GmbH retains its title to the merchandise.

§ 11 Data Protection
1. We take data protection seriously. All customer data are saved and processed by mytheresa.com exclusively in accordance with the relevant data protection laws. In particular, personal data are being collected, saved, and used exclusively for the purpose of processing the order or with your explicit consent. Addresses and order information will be stored in our data bases and used for internal marketing assessments. We do not store personal data any longer than absolutely required.
2. If you would prefer not to have your information used in this manner, please feel free to inform us regarding your decision by post, fax or an e-mail to info@mytheresa.com and we will immediately see to it that your request is granted. This of course does not pertain to information necessary to process your order. After we have received word of your decision, your information will be used for the sole purpose of processing your order and not for marketing or advertising actions.
3. We do not forward personal data to third parties except with regard to subcontractors of mytheresa.com that require the transfer of data to process the order. In these cases, however, the scope of the data transfer is restricted to the required minimum.
§ 12 Choice of Law, Validity
1. German law applies with the exception of the United Nations Convention on Contracts for the International Sale of Goods.
2. In case that one or more provisions are invalid, the validity of the remaining provisions remain unaffected.
